Definition

When a person is found by a court to be in Australia without lawful authority, the court can order them deported to their country of origin, if they do not leave of their own accord. Following deportation, a person is prohibited from returning to Australia lawfully for an extended period – a prohibition often exacerbated by fines or costs (such as the cost of being held in detention) that are held against them.

What makes it hot?

An issue for some people facing deportation remains the question of where they will be sent. While they may be required to leave Australia or be forcibly removed, if no country will accept them they may remain in Australia where they can stay in an Australian detention facility or prison for years awaiting a final destination. Some non-citizens who have served a period of prison are then deported – but their country of origin may refuse to accept them.
